1. Acceptance of Terms

By accessing or using the Loquia platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Loquia provides an AI-powered voice assistant platform for hospitality businesses. The Service automates call handling using artificial intelligence technologies.

3. AI Disclaimers & Liability

The Services utilize artificial intelligence and machine learning technologies ("AI Technologies") which are probabilistic in nature. You acknowledge and agree that:

  • Output generated by the Service may contain inaccuracies, errors, or "hallucinations".
  • You are solely responsible for verifying the accuracy of any Output before relying on it or presenting it to your customers.
  • Loquia makes no warranty regarding the accuracy, completeness, or reliability of any Output.
  • Loquia is not liable for any lost bookings, revenue, or customer disputes arising from AI-generated information.

4. Call Monitoring & Transcription Compliance

You acknowledge that the Service utilizes real-time speech-to-text technologies to generate transcripts of calls.

Consent Requirements: Although Loquia does not retain audio recordings, the generation and storage of text transcripts may fall under "wiretapping" or "eavesdropping" regulations in certain jurisdictions (e.g., "Two-Party Consent" states).

Your Responsibility: You agree that you are solely responsible for providing any necessary notices to callers (e.g., an automated announcement stating "This call is an automated assistant and may be monitored for quality").

Indemnity: You agree to indemnify Loquia against any claims arising from your failure to inform callers that their conversation is being transcribed or processed by an AI agent.

5. Subscription & Payments

5.1 Free Trial

Your subscription may start with a free trial of 7 days. On the 8th day, you will be automatically charged specifically for the subscription plan you selected.

5.2 No Refunds

All payments are non-refundable. We do not offer prorated refunds for partial subscription periods. You may cancel your subscription at any time to prevent future renewals.

5.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing cycle unless cancelled at least 24 hours before the renewal date through your account settings.

6. Limitation of Liability

To the maximum extent permitted by law, Loquia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

In no event shall Loquia's total liability to you for all claims exceed the amount you have paid us in the past twelve (12) months or one hundred U.S. dollars ($100.00), whichever is greater.

7. Indemnification

You agree to report, defend and indemnify Loquia and its officers, directors, and employees from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right or applicable law.
